Marital Problems: The Law Commission's ‘Getting Married’ Consultation Paper and Non-Qualifying Wedding Ceremonies

This article explores the Law Commission's proposals on how and where people can get married in England Wales as found their ‘Getting Married’ Consultation Paper. It examines extent to which will deal with or mitigate concerns expressed about two types of non-qualifying wedding ceremonies: ‘unregistered religious marriages’ couple undergo a ceremony that does not comply requirements Marriage Act 1949, ‘non-religious is conducted by celebrants representing belief organisation (such Humanists UK) independent so also outside 1949 currently legally binding. The largely welcomes but expresses concern proposed officiant system it defines organisation; changes law validity; creation new criminal offence. develops these three points further contends that, while transformed weddings could recognise non-religious marriages reduce number unregistered marriages, introduction statutory cohabitation rights upon separation needed truly over marriages.
